Controller and licensor: the provider identified above. POSPal currently operates under the Greek small-business VAT exemption regime, so VAT is not added to the subscription fee. Contact: [email protected].
1. Licence
Subject to this EULA and Subscription Terms, you receive a limited, non-exclusive, non-transferable, non-sublicensable licence for one (1) licensed Windows host. Authorised staff and devices on the same trusted LAN may use interfaces served by that host for the same business. This does not create another host licence.
2. Professional use and trial
The licence is Greece-only B2B. The 30-day trial needs no name, email, account, or card but uses technical identifiers/IP. Continued use needs an active subscription under the Subscription Terms.
3. Activation and cloud features
Internet is required for activation, periodic licence validation, billing, verification/recovery email, optional Customer Menu publishing, updates, and support reports. Core operational storage is local, but those categories are not exclusively local.
4. Restrictions
- Do not copy, resell, rent, assign, sublicense, or provide the software as a third-party service.
- Do not use one licence on a second Windows host.
- Do not bypass licensing, security, trial, or technical controls.
- Do not reverse engineer/decompile except where mandatory law permits.
- Do not remove proprietary notices.
5. Ownership and merchant content
POSPal is licensed, not sold. Software/documentation rights remain with the licensor. Merchants retain their menu and operational content and grant only the licence needed for their selected cloud feature.
6. Updates
The packaged app checks for and may automatically download/apply updates, including restart under app mechanisms. Updates are part of the Software. Keep workable backups and do not interrupt an update.
7. Data and merchant responsibilities
The merchant decides what to enter, ensures a lawful basis and notices, minimises personal data, secures the Windows host/LAN/accounts/PIN, and keeps backups. Do not put sensitive data in public menus or public reports. The Privacy Notice and DPA apply.
8. Support and availability
Support has no SLA or guaranteed response time. Software/cloud features are provided “as is” and “as available”, subject to non-excludable warranties. Uninterrupted/error-free operation or compatibility with every printer, network, or third party is not guaranteed.
9. Liability
To the maximum lawful extent, no liability applies for indirect/consequential loss, lost profit, or data loss, and aggregate liability is capped at subscription fees paid in the prior 12 months. The cap does not apply where prohibited, including fraud, gross negligence, death/personal injury, or non-excludable liability.
10. Suspension and termination
The licence may be suspended/terminated for non-payment, material breach, unlawful use, or security risk, with reasonable notice/cure where appropriate. Licensed use stops on termination. Ownership, liability, data, and dispute terms survive.
11. Law and entire set
Greek law and courts at the licensor's seat apply unless mandatory law says otherwise. The EULA, Subscription Terms, Privacy Notice, and DPA form the relevant contract set. Invalid provisions do not affect the rest.
Acceptance records
POSPal keeps versioned acceptance records containing the relevant document identifier and revision, acceptance timestamp and action context. Where an account is verified, acceptance is linked to that account; anonymous trial acceptance is linked to a technical host identifier. Previous 1.0 records remain historical evidence and do not establish acceptance of this revision. Publication or continued use alone does not establish such acceptance.
